Terms & Conditions of Carriage – Sipho Couriers Ltd

1. Introduction

These Terms and Conditions govern all services provided by Sipho Couriers. By booking or using our services, you agree to be bound by these terms.

Sipho Couriers accepts consignments for transportation subject only to these conditions.


2. Definitions

Consignment – Any parcel, package, pallet, document, or item entrusted to Sipho Couriers for delivery.

Customer – The individual or business arranging the shipment.

Consignee – The recipient of the consignment.

Transit – The period during which the consignment is in the possession or control of Sipho Couriers.


3. Customer Responsibilities

The customer confirms that:

  • They own the goods or are authorised to ship them.
  • The shipment details provided are accurate.
  • Goods are packaged securely and appropriately for transport.
  • Labels and delivery information are clearly displayed.
  • The goods comply with all applicable laws and regulations.

4. Prohibited and Restricted Items

Sipho Couriers will not transport:

  • Dangerous or hazardous goods
  • Explosives or flammable materials
  • Illegal substances
  • Live animals
  • Perishable goods unless agreed in advance
  • Cash, precious metals, jewellery, or securities
  • Firearms and weapons
  • Any item prohibited under UK law

Any undeclared prohibited item may be refused, returned, or disposed of at the customer’s expense.


5. Packaging Requirements

Customers must ensure all consignments are:

  • Properly packaged to withstand handling and transportation
  • Protected against movement during transit
  • Clearly labelled with accurate sender and recipient information

Sipho Couriers accepts no liability for damage resulting from inadequate packaging.


6. Collection and Delivery

We will make reasonable efforts to collect and deliver consignments within estimated times.

Delivery times are estimates only and are not guaranteed unless expressly agreed in writing.

If the recipient is unavailable:

  • A delivery attempt may be made.
  • A safe-place delivery may be completed where authorised.
  • Redelivery charges may apply.

7. Proof of Delivery

Delivery may be confirmed by:

  • Electronic signature
  • Photographic evidence
  • GPS delivery confirmation
  • Safe-place confirmation where authorised

Such records shall constitute proof of delivery.


8. Charges and Payment

Customers agree to pay all charges associated with:

  • Collection
  • Transportation
  • Delivery
  • Storage
  • Redelivery
  • Return shipments

Invoices must be paid according to the agreed payment terms.

Late payments may incur interest and recovery costs.


9. Liability for Loss or Damage

Sipho Couriers will exercise reasonable care while goods are in transit.

However, liability is limited and does not cover:

  • Indirect losses
  • Loss of profit
  • Consequential damages
  • Delays caused by circumstances beyond our control

Examples include:

  • Severe weather
  • Road closures
  • Industrial action
  • Vehicle breakdowns
  • Natural disasters
  • Government restrictions

10. Compensation Limits

Unless additional cover has been purchased and confirmed in writing before collection:

  • Compensation is limited to the actual value of the lost or damaged item.
  • Maximum compensation may be limited according to the service selected.

Customers should arrange appropriate insurance for high-value items.


11. Claims Procedure

Claims for loss, damage, or non-delivery must be reported:

  • Within 3 business days of delivery for damage claims.
  • Within 10 business days with supporting evidence and photographs.
  • Proof of value may be required.

Original packaging should be retained for inspection where applicable.


12. Undeliverable Shipments

If a shipment cannot be delivered and the recipient cannot be contacted:

  • The shipment may be returned to the sender.
  • Storage and return charges may apply.
  • Unclaimed consignments may be disposed of after reasonable notice.

13. Data Protection

Sipho Couriers processes customer and recipient information solely for the purpose of providing courier services and improving delivery communications.

We handle personal data in accordance with applicable UK data protection laws, including the UK GDPR and Data Protection Act 2018.


14. Force Majeure

Sipho Couriers shall not be liable for delays, failures, or losses caused by events beyond our reasonable control, including:

  • Extreme weather
  • Accidents
  • Government actions
  • Strikes
  • Public emergencies

15. Governing Law

These Terms and Conditions shall be governed by and interpreted in accordance with the laws of England and Wales.

Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
